Privacy Policy

This Privacy Policy explains how James Cacchione ("I", "me", "my") collects, uses, and protects your personal data when you use jcacchione.me or engage my web design services. I take privacy seriously and comply with the EU General Data Protection Regulation (GDPR) and Irish data protection law.
1. Who I am
Data controller: James Cacchione, a sole trader based in Cork, Ireland.

2. What data I collect
When you use the contact form
- Your name
- Your email address
- Business name (optional)
- The package you're interested in
- The message you send me
When you visit this website
- Basic server logs may record your IP address, browser type, and pages visited — used only for security and to keep the site running
- This site does not use analytics cookies or tracking pixels
When you become a client
To deliver services I may also collect: billing details, business information, content you provide for your project (copy, images, logos), and feedback during the design process.
3. Why I collect it (legal basis)
- To respond to your enquiry — legitimate interest in replying to people who contact me
- To deliver the services you've engaged me for — performance of a contract
- To send invoices and meet tax obligations — legal obligation under Irish tax law
- To improve my services — legitimate interest, based only on anonymised/aggregated information
I do not send marketing emails. If I ever introduce a newsletter, it will be opt-in only.
4. Who I share it with
Your data is not sold, rented, or traded. It is only shared with the following service providers necessary to run my business:
- Web3Forms (relays contact form submissions to my email inbox) — web3forms.com/privacy
- My email provider (delivers and stores our correspondence)
- My hosting provider (serves the website)
- Google Fonts — loaded by the browser to render page fonts. Google may receive your IP address as part of the font request. policies.google.com/privacy
- Accountant / Revenue — only as required by law for tax and bookkeeping
I may also disclose data where required by law, court order, or to protect legal rights.
5. How long I keep it
- Contact form enquiries that don't lead to a project: kept for up to 12 months, then deleted
- Client records and correspondence: kept for the duration of the project plus 7 years after final invoice (to meet Irish tax obligations)
- Server logs: rotated/deleted by my hosting provider, typically within 30 days
6. Your rights under GDPR
You have the right to:
- Access the personal data I hold about you
- Rectification — ask me to correct inaccurate data
- Erasure — ask me to delete your data ("right to be forgotten"), subject to legal retention requirements
- Restriction — ask me to pause processing your data while a dispute is resolved
- Portability — request a copy of your data in a machine-readable format
- Object — object to processing based on legitimate interest
- Withdraw consent — where processing is based on consent, you can withdraw it at any time

7. Right to complain
If you believe I've mishandled your personal data, you can complain to the Irish Data Protection Commission: dataprotection.ie.
8. Cookies
This website does not set any cookies. If I add analytics or third-party services in the future that require cookies, I will update this policy and request your consent first.
9. International transfers
Some service providers (e.g. Web3Forms, Google) may process data outside the EU. These providers operate under standard contractual clauses or equivalent safeguards that provide a level of protection compliant with GDPR.
10. Security
I use reasonable administrative and technical measures to protect your data, including HTTPS encryption on this website, strong passwords, and limiting access to only what is necessary for me to deliver services. No method of transmission over the internet is 100% secure, but I take security seriously.
11. Children
This website and my services are not directed at children under 16. I do not knowingly collect personal data from children.
12. Changes to this policy
I may update this policy from time to time. The "Last updated" date at the top will reflect any changes. Significant changes will be flagged on the homepage.
